    1) Legal information according to the General Data Protection Regulation

    By means of this data protection declaration, Kuhn Holding GmbH would like to inform the readers and users of the website (users) about the type, scope and purpose of the personal data processed.

    Furthermore, data subjects/users are informed of their rights by means of this data protection declaration.
    We know that the careful handling of your personal data is very important to you and appreciate your trust that we will handle this data conscientiously.

    The terms used in this declaration are based on the definitions of Art. 4 of the EU General Data Protection Regulation (GDPR).

    You have extensive rights under the General Data Protection Regulation, such as:

    • Right of access (Art. 15 GDPR)

    To exercise your rights, please contact us informally at dsvgo@kuhn.at or by post to: Kuhn Holding GmbH, Kuhn Strasse 1, A-5301 Eugendorf.

    Without prior successful identification, we cannot process petitions from affected persons. For this reason, we ask you to support the identification process accordingly. Kuhn will process your application within one month and inform you about the measures taken. We ask for your understanding that due to the complexity of individual applications or the large number of applications received, the one-month deadline may be exceeded when processing your application; your application will be fully processed within a further two months after the expiry of the one-month deadline and you will be informed of the measures taken once the processing process has been completed. In principle, applications are free of charge. However, Kuhn reserves the right, in the case of excessive or obviously unfounded applications, not to process them or to process them only against a cost fee of € 120.00 per working hour required. Should data be necessary for the assertion, exercise or defence of legal claims or for the fulfilment of contractual obligations, the request for deletion can only be processed after the compellingly necessary reasons for storage have ceased to exist. In cases of doubt, Kuhn reserves the right to request proof of identity for security reasons.If you are of the opinion that the processing of your data violates data protection regulations or that your data protection rights have been violated in any other way, you can complain to the supervisory authority. In Austria, this is the Data Protection Authority, Barichgasse 40-42 1030 Vienna. 

    3) Data transmission/data transfer

    Your personal data will not be transferred to third parties for purposes other than those listed below.

    We will only share your personal data with third parties if:

    • you have given your express consent in accordance with Art. 6 para. 1 lit. a DSGVO,
    • the disclosure is necessary in accordance with Art. 6 Para. 1 lit. f DSGVO to protect the interests of the company and to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
    • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 (1) lit. c DSGVO as well as
    • this is legally permissible and necessary according to Art. 6 para. 1 lit. b DSGVO for the processing of contractual relationships with you.

    In addition, the Controller may disclose your personal data if we are required to do so by law, regulation or if we believe that disclosure is necessary or appropriate to prevent physical harm or financial loss.

    In the event of an order or the conclusion of a contract, we will process the personal data (including name and delivery address, billing address) necessary for the execution and processing of the order/fulfilment of the contract on the basis of the fulfilment of the contract concluded with you or pre-contractual measures (Art. 6 Para. 1. lit. b DSGVO). We will forward your personal data (including name and delivery address, invoice address) to the sales, logistics and/or postal companies, payment service providers, accounting/tax advisors and, if applicable, our lawyer on the basis of the fulfilment of the contract concluded with you or pre-contractual measures (Art. 6 Para. 1. lit b DSGVO), the necessity of the fulfilment of legal obligations (Art. 6 Para. 1. lit c DSGVO) and our overriding legitimate interest (Art. 6 Para. 1. lit f DSGVO). 

    Data will not be passed on to third parties for advertising purposes.

    The controller may also transfer your personal data to countries outside the country where the information was originally collected, provided that there is a legal basis for doing so as described in the previous paragraph. These countries may not have the same data protection laws as the country where you originally provided the personal information. When we transfer your information to other countries, we protect that information as described in this Privacy Policy and those transfers are subject to the applicable law.

    The countries to which we disclose personal data are located in

    • within the European Union or 
    • outside the European Union

    When we transfer personal data from the European Union to countries or international organisations outside the European Union, the transfer is made on the basis:

    • of an adequacy decision of the European Commission;
    • in the absence of such, due to other legally permissible reasons such as the existence of a legally binding and enforceable document between the authorities or public bodies, binding internal company rules, standard data protection clauses and approved or certified codes of conduct.

    In exceptional cases, a data transfer may also take place on the basis of Art. 49 DSGVO:

    • Art. 49 para. 1 lit. a DSGVO
      The data subject has given his or her explicit consent to the proposed data transfer after having been informed of the potential risks to him or her of such data transfers in the absence of an adequacy decision and appropriate safeguards.
    • Art. 49 para. 1 lit. b DSGVO
      The transfer is necessary for the performance of a contract between the data subject and the controller or for the performance of pre-contractual measures at the request of the data subject.
    • Art. 49 para. 1 lit. c DSGVO
      The transfer is necessary for the conclusion or performance of a contract concluded in the interest of the data subject by the controller with another natural or legal person.

    4) Data collection and processing

    When you call up and visit this website, information is automatically sent to our website server by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

    • IP address of the requesting computer,
    • Date and time of access,
    • Name and URL of the retrieved file,
    • Website of origin (referrer URL),
    • The browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

    The possibility of using this data for purposes such as

    • ensuring a smooth connection of the website,
    • ensuring a comfortable use of our website,
    • Interest in the functioning of the website and defence against unauthorised access to the website,
    • the evaluation of system security and stability, and
    • for other administrative purposes

    is currently perceived by us. The data collected will in no case be used to draw conclusions about your person.

    Insofar as further personal data is collected on our website (e.g. as part of a contact enquiry, consent cookies and similar technologies), this is done on a voluntary basis by the website visitor (Art. 6 para. 1 lit a DSGVO - consent).

    You can use a contact form to send us enquiries, suggestions and requests. In order to contact us, it is necessary that you provide us with your data. Furthermore, you have to write a text in the corresponding field.

    You acknowledge that the aforementioned data will be processed by us for the purpose of handling or responding to your request. We cannot process your request without this information.

    If you send us an enquiry by e-mail, post or telephone, we will process your personal data required for this purpose (name, address, date of birth if applicable, e-mail address, telephone number, request) for the purpose of processing your enquiry and the associated activities.

    • Fulfilment of contract or pre-contractual measure according to Art. 6 para. 1 lit. b DSGVO.

    They can give their consent to receive various newsletters.

    You agree that the personal data required for this purpose may be processed by KUHN for the purpose of sending information about offers, product innovations and competitions in accordance with Art. 6 Para. 1 lit a,b and f DSGVO.

    KUHN may arrange for the transfer of your personal data to processors. Your personal data will be processed by the processor exclusively on our instructions and for the defined purpose.

    The consent you have given can be revoked at any time in accordance with Art. 6 para. 2 lit c DSGVO without affecting the lawfulness of the processing carried out on the basis of the consent until revocation. You can also cancel the newsletter subscription at any time by clicking on unsubscribe from each newsletter/mailing.

    If you revoke your consent pursuant to Art. 6 para. 2 lit c DSGVO, your personal data will be routinely blocked or deleted in accordance with the statutory provisions, unless otherwise stipulated by law.

    We use the MailChimp component to send our newsletter. MailChimp is a service provided by The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30318, USA. The processing is based on your consent pursuant to Art. 6 (1) (a) DSGVO or our legitimate interest pursuant to Art. 6 (1) (f) DSGVO.

    Your data stored during newsletter registration (title, first name, surname, e-mail address, IP address, date and time of your registration) is transferred to a server of The Rocket Science Group in the USA and stored there in compliance with the EU standard contractual clauses.

    You can cancel or revoke your subscription to this newsletter and thus your consent to the storage of your data at any time in the future.

    Registration for our newsletter takes place in a so-called double opt-in process. This means that after registration you will receive an email asking you to confirm your registration.

    The registrations for the newsletter are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address.

    When you call up the newsletter, technical information such as information on the browser and your system, as well as your IP address and the time of the call-up are initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined with the help of the IP address) or the access times.

    The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is not our intention to observe individual users. The analyses serve us much more to recognise the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

    We ask for your consent in this regard at the appropriate point as follows: "Consent to the newsletter according to DSGVO." With the revocation of the consent to receive the newsletter, the consent to the aforementioned tracking is also revoked.

    Our newsletters contain so-called tracking pixels (web bugs), which enable us to recognise whether and when an email was opened and which links in the email were followed by the personalised recipient. We store this data so that we can optimally tailor our newsletters to the wishes and interests of our subscribers. Accordingly, the data collected in this way is used to send personalised newsletters to the respective recipient. We ask for your consent in this regard at the given point as follows: "Consent to the newsletter according to DSGVO." With the revocation of the consent to receive the newsletter, the consent to the aforementioned tracking is also revoked.

    7. Google Tools

    This website uses Google Analytics, a web analytics service provided by Google, Inc (hereafter: Google). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, due to the activation of IP anonymisation on these websites, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

    You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.     We use the function "Activation of IP anonymisation" on this website. However, this means that your IP address is shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

    This website uses Google Signals and thus expands the existing Google Analytics functions. For this purpose, additional information is collected from users who are actively logged into their Google account, transmitted to Google, linked to the website visit data and evaluated. The website operator can use this information to optimise its web offers (extension for cross-device remarketing).

    The following additional information can be collected:

    • Data about the actions on our website
    • Data from websites that work with Google

    This cross-device tracking information is aggregated and anonymised by Google. It should be noted that the anonymisation on the part of Google is not transparent and legal compliance with the GDPR cannot be guaranteed.

    The aggregated data generates better advertising reports (groups of people, target groups, ...) and useful information on interests, locations, age, language, gender, profession, marital status, income, ...

    The storage period of this information is limited to 26 months.

    Our websites use the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

    This function makes it possible to link the advertising target groups created with Google Analytics Remarketing with the cross-device functions of Google Ads and Google DoubleClick. In this way, interest-based, personalised advertising messages that have been adapted to you depending on your previous usage and surfing behaviour on one end device (e.g. mobile phone) can also be displayed on another of your end devices (e.g. tablet or PC).

    If you have given your consent, Google will link your web and app browsing history to your Google Account for this purpose. In this way, the same personalised advertising messages can be served on every end device on which you log in with your Google account.

    To support this feature, Google Analytics collects Google-authenticated IDs of users, which are temporarily linked to our Google Analytics data to define and create target groups for cross-device ad advertising.

    You can permanently object to cross-device remarketing/targeting by deactivating personalised advertising in your Google account; follow this link: https://www.google.com/settings/ads/onweb/.

    The aggregation of the collected data in your Google account is based exclusively on your consent, which you can give or revoke at Google (Art. 6 para. 1 lit. a DSGVO). In the case of data collection processes that are not merged in your Google Account (e.g. because you do not have a Google Account or have objected to the merging), the collection of data is based on Art. 6 (1) lit. f DSGVO. The legitimate interest results from the fact that the website operator has an interest in the anonymised analysis of website visitors for advertising purposes.

    This website uses the Google Tag Manager. Through this service, website tags can be managed via an interface. The Google Tag Manager only implements tags. No cookies are set and no personal data is collected. The Google Tag Manager triggers other tags that may collect data. The Google Tag Manager does not access this data. If a deactivation has been made at domain or cookie level, it remains in place for all tracking tags, insofar as these are implemented with the Google Tag Manager.     We use the online advertising programme "Google AdWords" and, as part of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). When you click on an ad placed by Google, a cookie for conversion tracking will be placed on your computer. These cookies lose their validity after 30 days, do not contain any personal data and are therefore not used for personal identification.

    If you visit certain web pages on our website and the cookie has not yet expired, Google and we can recognise that you clicked on the ad and were redirected to that page. Each Google AdWords customer receives a different cookie. Thus, there is no possibility that cookies can be tracked across the websites of AdWords customers.

    The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. Here, the customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

    If you do not wish to participate in tracking, you can object to this use by preventing the installation of cookies through a corresponding setting in your browser software (deactivation option).
